TERMS AND CONDITIONS OF PARTICIPATION AND INFORMATION RELATING TO THE USE OF PERSONAL DATA IN THE CONTEXT OF THE 2023/24 player of the season vote

1. . The organizer of this competition is Bayer 04 Leverkusen Fußball GmbH (hereinafter referred to as ''Bayer 04'), Bismarckstr. 122 - 124, 51373 Leverkusen, Germany.

2. Participation in the raffle is free of charge.

3. Only one entry per person is permitted per competition.

4. Bayer 04 employees, employees of the agencies involved in the promotion and their respective relatives are excluded from participation.

5. The competition ends on June 21th, 2024 at 23.59 (CET).
6. Participation in the competition occurs by voting for the 2023/24 Bayer 04 player of the season.
7. The winners will be chosen at random from all participating Bayer 04 members.
8. The winners will be notified by e-mail and requested to contact Bayer 04 by personal message. If the winner does not contact Bayer 04 within 3 days after notification, the claim to the prize will be forfeited and a new winner will be drawn.

9. The following prizes can be won:

• Main prize: 1x1 Member of the matchday for the first home game of the coming season
• 1x2 seats for the 1st day trip to the away game in the 2023/24 season (including arrival and departure as well as the ticket)
• 3x1 new home jersey for the 2024/25 season
• 5x1 voucher valued 19.04 Euro each for the Bayer 04-Shop

10. A cash payment of the prize value or an exchange of the prize is excluded.

11. Claims to prizes are non-transferable.

12. Bayer 04 is entitled to exclude participants who are suspected of violating the conditions of participation or in the event of some other form of manipulation from taking part in the competition and, if necessary, to disallow and reclaim any winnings at a later date.

13. Participants shall indemnify Bayer 04 against all claims by third parties in connection with participation in the competition. Participants who, in the context of participation in the competition, make statements or carry out actions which, in the opinion of Bayer 04, violate applicable laws, morality or the rules of good taste, in particular statements or actions glorifying violence, pornographic or politically incorrect statements or actions, or make statements or carry out actions which damage the reputation of Bayer 04, may be excluded from participation in the competition at any time.
14. Bayer 04 reserves the right to terminate or interrupt the competition at any time for good cause without prior notice. This applies in particular in the event of reasons that jeopardise or prevent the competition from running as planned. In this case, claims for damages by participants are excluded.

15. We reserve the right to make changes to the specific design of the prizes.

16. Bayer 04 reserves the right to change or terminate the promotion at any given time without prior notice and without stating reasons. Bayer 04 shall make use of this option in particular if proper implementation of the promotion cannot be guaranteed for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons. If such a termination is culpably caused by the conduct of a participant, Bayer 04 may demand compensation from this person for the damage incurred.

17. Bayer 04 shall be liable in accordance with the statutory provisions insofar as claims for damages are asserted which are based on intent or gross negligence. Insofar as Bayer 04 is not charged with intentional breach of contract, the liability for damages shall be limited to the foreseeable, typically occurring damage. Bayer 04 shall be liable in accordance with the statutory provisions if it culpably breaches a material contractual obligation. In this case, too, the liability for damages shall be limited to the foreseeable, typically occurring damage. Liability for culpable injury to life, limb or health shall remain unaffected. This also applies to mandatory liability under the Product Liability Act. Any further liability for damages than previously provided for is excluded - regardless of the legal nature of the asserted claim. Insofar as the liability for damages against Bayer 04 is excluded or limited, this shall also apply with regard to the personal liability for damages of its employees, workers, staff, representatives and agents.

18. Bayer 04 accepts no liability whatsoever for the prizes provided as part of the competition, their freedom from defects or any damage arising from their use or claim. Bayer 04 accepts no liability for interruptions and non-availability of the competition due to technical faults and failures.

19. German law shall apply. The exclusive place of jurisdiction for all legal disputes arising from or in connection with these conditions of participation or this promotion is Leverkusen.

20. There is no entitlement to the award of a prize. The legal process is excluded.

Data protection
(1) Insofar as personal data of participants is collected in the course of the promotion, it will be used by Bayer 04 exclusively for the purpose of carrying out the promotion and associated obligations arising from the contract. For example, we will use your title, first and last name and address to send you the prize. The legal basis for the processing is Art. 6 para. 1 lit. b DS-GVO (General Data Protection Regulation); if you have given your consent, Art. 6 para. 1 lit. a DS-GVO also applies.
(2) On conclusion of the contract, we collect the following personal data about you as the winner:
• Form of address
• First name and surname
• Your address
• If applicable, different Facebook profile name at the time of the competition
• Telephone number, if applicable (for clarification of queries)
• E-mail address (if applicable) (for clarification of queries)
• Date of birth (if applicable) (for age validation)
• Type of prize / prize
(3) In order to fulfil our contractual and legal obligations, we pass on your personal data to internal departments. Your personal data will not be passed on to so-called third parties unless there is a legal obligation to do so, you have consented to the transfer or the transfer is necessary for the fulfilment of a contract between you and us.
(4) Your personal data will be deleted if this does not conflict with statutory retention obligations, if the data is no longer required to fulfil the purpose for which it was stored, if you have asserted a claim for deletion or if its storage is inadmissible for other legal reasons.
(5) Participants / winners are free at any time to revoke their consent to storage by sending a revocation to info@bayer04.de and thus withdraw from participation. In the event of a revocation, the personal participant / winner data will be deleted from the database without delay, provided that this does not conflict with statutory retention periods. If the withdrawal is made before the prize has been processed, further participation is thereby excluded.
